McKinstry Family Karate – Terms and Conditions

1. Membership and Training Fees

1.1. McKinstry Family Karate offers special promotions from time to time, including a three-month trial that allows new students to experience our training before committing to a full membership.

1.2. Our regular membership is based on a 12-month programme, which can be paid in 12 equal monthly instalments.

1.3. Each instalment is based on a four-week month, meaning that membership covers 48 training weeks per year, accounting for holidays and student absences.

1.4. All fees must be paid on time via the payment method agreed upon at registration. Late payments may result in suspension of training privileges.

1.5. Prices are reviewed annually and may be subject to change. Members will be notified at least 30 days in advance of any price adjustments.

1.6. Memberships can be cancelled by providing one month’s written notice. No refunds will be given for any unused portion of the membership after cancellation.

2. Class Cancellations and Holiday Closures

2.1. McKinstry Family Karate reserves the right to close the dojang on public holidays, in cases of adverse weather conditions, infrastructure failures, illness, civil unrest, or war.

2.2. No refunds or make-up sessions will be issued for missed classes due to these circumstances.

3. Student Licensing and Grading

3.1. All students graded above white belt must hold a valid licence to continue training and grading.

3.2. McKinstry Family Karate participates in the BMABA Lifetime Student Grading Register, where student grading records are maintained.

3.3. Students’ personal data may be shared with BMABA and third-party management systems (such as Club Link) for grading and club administration purposes.

3.4. All data shared is handled in compliance with the General Data Protection Regulation (GDPR).

3.5. A Privacy Policy outlining how personal data is processed, stored, and retained can be requested or accessed via our website.

4. Legal Waiver and Assumption of Risk

4.1. Martial arts training involves physical activity and contact, which carry inherent risks, including but not limited to sprains, bruises, fractures, and other injuries.

4.2. McKinstry Family Karate takes all reasonable steps to ensure a safe training environment. However, students (or their legal guardians if under 18) acknowledge and accept that martial arts training carries inherent risks, except where injury results from the club’s negligence.

4.3. By participating in classes, students voluntarily accept these risks and agree not to hold McKinstry Family Karate, its instructors, assistants, and affiliates liable for any injury, loss, or damage, except in cases of gross negligence.

4.4. Students must inform instructors of any pre-existing medical conditions or injuries that may affect their ability to train safely.

4.5. In the event of an injury or medical emergency, the student (or their guardian) authorises instructors to seek medical assistance if necessary.

5. Payment Processing and Data Protection

5.1. Membership payments are processed via third-party payment providers (e.g., card and bank processing services).

5.2. These third parties, along with Club Link and BMABA, are GDPR compliant and handle personal data securely.

5.3. By signing up for membership, students agree to the collection, storage, and processing of their data for club administration, grading, and licensing purposes.

5.4. Members can request access to their personal data or request its deletion, subject to legal and administrative requirements.

6. Intellectual Property Rights (IPR)

6.1. All written, electronic, and video materials provided by McKinstry Family Karate are the intellectual property of the school.

6.2. These materials must not be copied, shared, or distributed without prior written permission.

6.3. Access to training resources is subject to active membership. Upon membership termination, all access and rights to use these materials will be revoked.

6.4. Any unauthorised use of McKinstry Family Karate’s intellectual property may result in legal action or termination of membership.

7. Pro Shop and Product Sales

7.1. McKinstry Family Karate offers equipment, apparel, and training gear for sale through our Pro Shop.

7.2. All sales are final unless the product is defective or does not match its description.

7.3. Refunds or exchanges for defective or incorrect items must be requested within 14 days of purchase with proof of purchase.

7.4. McKinstry Family Karate is not responsible for normal wear and tear on purchased items.

7.5. Items must be collected in person unless otherwise agreed upon.

8. Membership Agreement

8.1. By enrolling in McKinstry Family Karate, students and/or their legal guardians agree to abide by these Terms and Conditions.

8.2. McKinstry Family Karate reserves the right to update these terms periodically. Any significant changes will be communicated to members via email or our website.

9. Termination of Membership

9.1. Memberships are based on annual programmes, meaning that members commit to a 12-month programme upon enrolment (unless enrolled on a 3-month trial or other offers)

9.2. Members may terminate their membership by providing one month’s written notice before the renewal date. No refunds will be issued for any remaining portion of the membership after cancellation, except in exceptional circumstances as outlined below.

9.3. Early termination will only be considered on a case-by-case basis in the event of:

Financial hardship (evidence may be required).

Serious injury or illness that prevents participation (medical proof may be requested).

Relocation outside the area, making regular attendance impractical (proof of address change may be required).

Death of the member (the account will be closed without further charges).

9.4. Members requesting early termination must submit their request in writing along with supporting documentation. McKinstry Family Karate will review each case sympathetically and fairly.

9.5. If a member fails to meet their payment obligations, McKinstry Family Karate reserves the right to suspend or terminate the membership. Any outstanding fees will remain payable.

9.6. McKinstry Family Karate reserves the right to terminate a membership without refund if a student:

Engages in repeated disruptive behaviour or misconduct that affects other students or instructors.

Violates club policies or engages in behaviour deemed unsafe.

Fails to comply with the terms of payment.

9.7. Terminated members will lose access to all training materials, online content, and membership privileges.

By signing up for classes, students (or their legal guardians) confirm that they have read, understood, and agree to these Terms and Conditions.
